Alberta Fly Fishing Adventures Participant Waiver and Release Agreement
NOTICE: THIS IS A LEGAL WAIVER AND RELEASE OF LIABILITY
By booking and confirming your Trip with Alberta Fly Fishing Adventures, you acknowledge and agree to the terms outlined in this waiver.
Consideration
In consideration for being allowed to engage in the activities organized by Alberta Fly Fishing Adventures, I agree to this waiver and release as follows:
Awareness of Risks
I understand and accept that participating in outdoor activities like fishing, boating, and hiking involves inherent risks that cannot be eliminated. These risks are particularly significant in wilderness settings and include, but are not limited to:
- Hazards associated with water activities, including boating and wading, with potential risks such as drowning;
- Slips, trips, and falls during hikes in rugged terrain;
- Injuries caused by fishing equipment or interactions with other participants;
- Encounters with wildlife, insects, and other natural hazards;
- Exposure to extreme temperatures and weather conditions, which may lead to heatstroke, frostbite, or other health issues;
- Limited access to communication and medical assistance in remote areas.
I acknowledge that I have had the opportunity to discuss these risks with my guide or representative from Alberta Fly Fishing Adventures. I am aware that these activities demand physical ability, specific skills, and preparedness. I confirm that I possess the physical fitness and necessary skills to participate safely. My involvement is voluntary, and I choose to proceed despite the known and unknown risks.
Acceptance of Responsibility
By choosing to participate in activities provided by [Your Business Name], I willingly accept all risks, including the possibility of injury, paralysis, or death. I understand it is my responsibility to act with caution and adhere to safety guidelines.
Release and Indemnity
In consideration of being permitted to engage in these activities, I, on behalf of myself, my heirs, executors, administrators, and assigns, hereby release and discharge Alberta Fly Fishing Adventures, its employees, guides, agents, contractors, volunteers, and affiliates from any and all claims, demands, liabilities, or legal actions arising from or connected to my participation. This includes but is not limited to claims of negligence or any other fault, whether foreseeable or unforeseeable, resulting in personal injury, property damage, or death.
Additionally, I agree to indemnify and hold harmless Alberta Fly Fishing Adventures and all associated individuals or entities against any claims, lawsuits, or liabilities brought by third parties arising from my conduct during the activities.
No Legal Recourse
I further agree that I will not initiate legal action against Alberta Fly Fishing Adventures, its employees, or affiliates for any injuries, losses, or damages sustained during my participation. Any injuries or incidents resulting from these activities are solely my responsibility.
Acknowledgment and Agreement
By signing below, I confirm that I have carefully read and fully understand this agreement. I acknowledge that this document limits my legal rights and that I am signing it voluntarily and without coercion.
I have read carefully, clearly understood, and voluntarily signed this waiver and release agreement.
